If your iphone is old bootrom vesion, you can use Pwnagetool on MAC or Snowbreeze on PC to create a custom firmware to go to 3.1.3. Using the same procedure you could also go to 4.0.

In the cases above, you would not need to activate because they allow you to hacktivate your phone.

If you are new bootrom, and since you have SHSH on file for 3.1.3 then just restore with a stock 3.1.3 firmware and then use sp1rit to JB. You will need to activate your phone with a sim. Instructions to upgrade will be the same as for downgrading, there's a guide here: Downgrade iOS 4.0.2 to iOS 4.0.1 / 4.0 iPhone 4, 3GS, iPod touch [How to Guide] | Redmond Pie

I believe you might still be able to get a 4.0.1 SHSH file, so if you have a sim for activation you can upgrade to stock 4.0.1 and use Jailbreakme.

thanks for the reply. i have an old bootrom and i want to be on 3.1.3 as i have battery drain issue when i jailbroke using Blacksnow on 3.1.2. so i want to upgrade to 3.1.3 and use spirit to jailbreak and monitor my battery performance. do i still need to have an active AT&T sim to go to 3.1.3?

Yes you will need a sim if you want to jailbreak through spirit.

I would suggest you use custom firmware for 3.1.3 created with pwnagetool/snowbreeze. Once you restore with this you will be automatically JB and hacktivated (no sim required).
