• Samsung Denies Copying Apple while Attributing its Success to its Marketing Efforts

    Samsung brought up two company executives and three Google engineers recently to further prove its case of non-infringement of the five Apple patents. Re/code has reported that senior UI designer from Samsung, Executive Youngmi Kim, denied that the company’s software was borrowed from Apple’s designs. Kim was asked if Samsung stole the ‘slide-to-unlock’ feature from Apple, with what Kim responded:

    Absolutely not. If we were to work on the same thing as Apple, that would not give us any advantage in terms of differentiating our products, so that would not make any sense.
    On top of patent talk, the third week of the trial consisted of a strategy to prove that marketing was what pushed Samsung smartphones to the top of the smartphone charts. A testimony from Samsung America’s chief marketing officer, Todd Pendleton, stated that Samsung had a major branding issue when it came to smartphones. According to Pendleton, he did not even know the company had a smartphone lineup when he joined the company in 2011. He stated:

    I think people knew Samsung for televisions. But in terms of smartphones, there was no recognition for what our product was or what it stood for.
    During the cross examination, Apple counsel presented an e-mail from Dale Sohn, former Samsung executive, that stated,

    Beating Apple is no longer merely an objective. It is our survival strategy. There will be a tsunami when iPhone 5 is coming.
    Pendleton admitted that the company had an idea on how to disrupt the upcoming iPhone launch.

    Lastly, Google engineers were called by Samsung to testify that some features seen in its phones, like data syncing, are main functions of the Android operating system. This is not the first time Google was asked to prove certain features alleged to infringe on Apple’s patents.

      if Samsung are to blame then so is Google, seen as they own Android!!!; this has been blown all out of per portion and Apple don't seem to have the balls to go after google

      Baby steps. Once you prove Samsung has infringed on products and win, then you can move on to Google.

      Samsung stole the ‘slide-to-unlock’ feature from Apple, and others and they got caught now it is time to pay up. then go after the small potatoes

      Why go after google right now? Prove that Samsung is guilty and google will have to change their code anyways. Google doesn't actually sell any products worth going after. The nexus is not worth going after. Apple wants to get $ per phone but more importantly, prove that it's their code.

      Apple never made a phone. They just made music devices, laptops and desktops. Samsung had made phones for years . They still trotted out the usual standard phones no innovations, and kept selling same old rubbish for nice big profit thank you.

      Apple comes along, first time ever making a phone, never did one ever before, and makes samsung phones look like something from a bye gone age. Then Sammy say "its all down to our marketing" EH!

      Guys if you were so great why did it take a new commer in the market to do it, not you boys who have been in it for years and years. Its so blatently a copy.

      They both steal from each other. Why does this matter? Seriously? I mean come on. Both companies wouldn't be around in the market without each other anymore.

      Even if Apple can prove Google being at fault, it could not get financial compensation since Google doesn't directly profit from Android.
