• Apple Ends up Winning its Legal Battle Involving IP Owned by ContentGuard

    Apple recently came out ahead in a legal battle involving digital rights management intellectual property which was owned by ContentGuard. For those of you who didnít know, ContentGuard is a subsidiary of non-practicing entity Pendrell Corp that previously sued Apple for infringing on five patents. The jury recently handed down its decision in the US District Court for the Eastern District of Texas finding Apple not in infringement of the five DRM-related patents. Though the Cupertino California company isnít responsible for damages, Apple wasnít able to prove the patents invalid.

    The Cupertino California company was accused of illegally applying patented DRM technologies to its digital content distribution services including music, movies and TV shows sold through iTunes and ebooks marketed in iBooks. Apple ended up denying these claims.

    The recent decision came just after ContentGuard first asserted its clutch of patents against several big tech industry players in 2013 including Amazon, Samsung, BlackBerry, Motorola and HTC and others. According to Law360, Google and its online music, movie and ebook storefronts were all added to the list od defendants back in 2014 as well.

    Despite all of its efforts, ContentGuard ended up seeing limited success. Aside from one favorable ruling from the US Patent and Trademark Officeís Patent Trial and Appeal Board in June, which caused Amazon to settle a month later, the patent holder ended up losing cases against Google and Samsung. Similar to Apple though, both Google and Samsung werenít able to convince juries that ContentGuardís patents were invalid.

    Fortunately for Apple, this is one less legal issue for the company to worry about, at least in the short term.
