• Samsung Agrees to Pay Apple $548 Million for Infringing on the Company's Patents



    After several years of trials, retrials and appeals, this past week, Samsung said it has agreed to pay Apple $548 million for infringing on Apple’s patents. In a jointly filed case management statement submitted to the US District Court for the Northern District of California, Samsung said that it “has made arrangements” with Apple to complete a damages payment that totals $548,176,477. The payment is said to take place ten days after Apple sends an invoice, which translates to December 14 if the document is delivered by December 4, local Korea time.

    Florian Mueller of FOSS Patents mentioned that Samsung’s actions prior to the statement suggested that the company would move forward with a Supreme Court appeal related to the first Apple vs. Samsung judgment. Though it plans to pay up, Samsung is reserving the right to reimbursement if judgement is reversed, modified, vacated or otherwise changed in its favor. This includes the results of any USPTO Patent Trial and Appeal Board actions and Supreme Court petitions. The validity of Apple’s ‘915 patent for pinch-to-zoom functionality is currently under scrutiny by the PTAB, while Samsung previously voiced its intent to argue design patent claim and construction in front of the Supreme Court.

    As far as Apple goes, the Cupertino California company disputed Samsung’s claim to reimbursement rights.

    Even though at first glance it appears to be “over,” the Apple vs. Samsung case is far from being resolved. In September, both parties announced that the payout is tied to Apple’s first California patent infringement suit against Samsung, a subsequent partial retrial and successful CAFC appeal eroded that initial amount of $1.08 billion to $548 million.

    We’ll have to wait and see what happens next.
