    Couldn't find this question anywhere.

    I am upgrading from a jailbroken 3GS to a new iPhone4 from the apple store.

    When I activate and setup the new phone, will it force me to upgrade to the new software? Of course I refuse to haven an un-jailbroken iPhone, and I am finding conflicting info on jailbreaking the 4.1 - IS THERE ONE??

    Also, if anyone knows, what are the differences between the 4.0 and 4.1 software?

    No jailbreak yet for 4.1. And at this point you'll be very lucky to get a 4.0.1 FW iPhone 4 from Apple or AT&T. 4.0.1 is the most recent that can be jailbroken. You will most likely get 4.0.2 or 4.1.
    When you activate not sure if it will force the new FW on you.

    Upgrading has nothing to do with warranty. Yes you can upgrade your iOS.
