    In a recently joint court filing, Apple, Google, Adobe and Intel recently mentioned settlement talks have resumed in the anti-poaching lawsuit. The renewed mediation comes after Judge Lucy Koh who denied an initial $324.5 million settlement proposal last month. She claimed in her order that defendants need to “pay their fair share” for falsely suppressing wages.

    For those of you who didn’t know, plaintiffs first sued the four tech giants in 2011 over anti-poaching schemes which were supposedly designed to stifle competition. One of the immediate side effects of the actions was wage stagnation. The defendants reached an initial settlement agreement in April but the $324.5 million figure was one that became an issue for Judge Koh. She believed the class had enough leverage to move to a trial phase, referring to email correspondence between company CEOs like Steve Jobs.

    The plaintiffs originally sued for damages which reached $3 billion which could be trebled to $9 billion under federal law. Judge Koh ended up signing off on a related round of settlements from other companies such as Lucasfilm, Pixar and Intuit for roughly $20 million at the time as well. The talks are set to continue and parties will be moving forward toward a court trial which will meet at a hearing on September 10. We’ll have to wait and see what happens.
