    Apple recently filed a motion to dismiss a lawsuit that was leveled by battery maker A123 over alleged poaching activities. The Cupertino California company claims that the complaint fails to meet certain legal requirements. In its court filing, Apple argues that A123’s original complain “fails to state a claim upon which relief may be granted.” This means that A123 failed to meet minimal pleading requirements.

    For those of you who aren’t familiar with the matter, A123 is suing Apple for allegedly poaching five key employees from the battery maker’s advanced System Venture Technologies Division. The division’s duties aren’t clear but the company does claim its employees left “under suspicious circumstances,” all of which started with CTO Mujeeb Ijaz. Along with these individual claims against the former employees relating to breaches of non-disclosure, non-compete and non-solicitation clauses, A123 also claims that Apple intentionally interfered with contractual obligations while raiding its business.

    The news all comes at a time when rumors of the Apple Car are afloat. Many are speculating that Apple is building out an advanced batteries division in an effect to creating electric vehicle cells. It was previously reported that both Apple and A123 were to engage in settlement talks but the discussions haven’t led to any agreement. We’ll have to wait and see what happens.
